On August 28, my son and I were out of town at my father's house. That morning, as I normally do, I checked Informed Delivery through the postal service. I saw that a letter was coming from Samantha Jacobs, the attorney representing Interstate Credit Union.

In my recollection, the case had gone quiet enough that I had started thinking maybe that was it. Maybe it was over. Seeing that letter coming triggered something.

I felt like I was being bullied. I felt they were trying to intimidate me. I was looking at an institution with resources I couldn't match, and I decided I would do something about it.

Until then, I had been going to the courthouse and getting things filed manually. I learned about PeachCourt, the electronic filing system.

I saw the notice of the November 12 hearing before the letter itself had arrived. Before the mail ran that day, and before I got off that couch, I had submitted several filings.

One was a motion for leave to amend my answer and bring counterclaims. I hadn't included counterclaims in my May answer because I didn't know what that meant. Now I was asking permission to expand my defenses and bring claims against Interstate in the case it had started against me.

I also submitted an additional answer-related filing and a proposed order for the judge to consider signing. I learned that "leave" meant permission. I was asking the judge for permission to put my own claims into the case.

August 28 was when I began actively litigating this. Since then, I have been learning and working on it pretty much daily. For me, that was the point when I decided to stand up for myself.

Documents and dates

The docket records an August 21 notice of a November 12 hearing and an amended notice on August 24. On August 28 it lists Item 19, a Rule 5.2 discovery-service certificate; Item 20, the motion for leave; Item 21, an Answer with no further description; and Item 22, a proposed order. The contents of Item 21 have not been independently identified here.

Discovery was also served August 28, seeking records and admissions about the vehicles and deficiency accounting. The docket includes discovery activity between May and August, including Gregory's June 10 response; his recollection that things had gone quiet describes his experience, not an absence of docket activity.
